A. General Terms and Conditions of Jobriver.de for all users
§ 1 Scope of these terms
1.1 The operator of the Jobriver.de portal is FINK GROUP LLC (hereinafter "Jobriver.de"). The following terms apply to all users of the jobriver.de portal and the services offered there, including all subdomains. By users, Jobriver.de means both job seekers and employers.
1.2 Job seekers are users who wish to find out about open positions on Jobriver.de, apply for specific positions or seek other information in the area of jobs and careers.
1.3 Employers are all companies, institutions, natural persons, etc. that commission Jobriver.de to place job ads or so-called employer branding products (e.g. ads, banners, company profiles, etc.) or that place such items.
1.4 Job seekers and employers are jointly referred to as "users".
1.5 Special Terms and Conditions for job seekers (see section B) and employers (see section C) apply. In case of doubt, the special terms and conditions take precedence over the general terms and conditions.
1.6 By using the portal, the user declares that they have read, acknowledged and accepted the GTC.
1.7 Jobriver.de reserves the right to change these terms at any time. Changes will be communicated to users in good time. The change is deemed approved if the user does not object within 30 days of receiving the notice of change and/or terminate an existing contract.
§ 2 Equal treatment and diversity
2.1 All content on Jobriver.de – including job listings, job titles and editorial texts – is addressed equally to all genders (m/f/d) as well as to people of any origin, age, religion, sexual orientation, gender identity and physical or mental condition. Even if, for better readability, only one gender form is used in individual cases or the (m/f/d) suffix is not explicitly stated, all genders and identities are always addressed equally.
2.2 Employers are obliged to design their job listings and content published on Jobriver.de in accordance with the General Equal Treatment Act (AGG) and all applicable anti-discrimination regulations. Jobriver.de reserves the right to remove content that violates these principles.

§ 3 Content
3.1 Jobriver.de is an internet job market for connecting employers and job seekers, in particular through job listings and their publication.
3.2 Jobriver.de's offering includes:
a) Job listings
3.3 In the job listings area, employers offer information about positions to be filled and the opportunity to conclude a service contract as an employment contract. Job seekers are either linked to an existing employer website with an online application option or can apply to the employer by email. Job seekers have detailed selection options for a targeted job search.
§ 4 Payment obligations
4.1 Jobriver.de offers both free and paid services. Only services expressly designated as such, such as placing job ads, are subject to charge.
§ 5 Disclaimer of warranty and definiteness of the subject of performance
5.1 Jobriver.de does not owe any particular success and does not guarantee the finding of new employment contract partners or the successful conclusion of employment contracts.
5.2 Jobriver.de only warrants that the website is generally available. Jobriver.de assumes no warranty for the accuracy or completeness of the information provided and is not liable for the content of users.
§ 6 Copyright, content rights and data protection
6.1 All copyright and protective rights to the portal content, including layout, software and certain content, belong to Jobriver.de.
6.2 Users may post their own content in the designated areas of the portal, but such user-generated content remains the property of the users. Jobriver.de reserves the right to delete user-generated content if it violates these GTC or is unlawful.
6.3 Users grant Jobriver.de the right to use their content in connection with its publication on Jobriver.de and for the self-promotion of Jobriver.de.
6.4 Users guarantee that the content they post is free of third-party rights and will indemnify Jobriver.de against any third-party claims arising from the use of their content.
§ 7 Liability
7.1 Jobriver.de is liable in cases of intent and gross negligence as well as in the case of fraudulent misrepresentation and for damages resulting from injury to life, body or health in accordance with statutory provisions.
7.2 Otherwise, Jobriver.de is only liable for damages based on a breach of essential contractual obligations. In this case, liability is limited to the typically foreseeable damage.
§ 8 Miscellaneous
8.1 The place of jurisdiction for all disputes arising from or in connection with this contractual relationship is Düsseldorf. In all other cases, Jobriver.de or the user may bring an action before any legally competent court.
8.2 Should any provision of these GTC or any other agreement be or become invalid, this shall not affect the validity of the remaining provisions.
8.3 Jobriver.de is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
B. Special Terms and Conditions for job seekers
§ 1 Registration as a job seeker
1.1 Using some features on Jobriver.de requires registration as a job seeker. When registering, users must provide accurate and up-to-date information.
1.2 Job seekers are responsible for keeping their user account and login details confidential. Jobriver.de assumes no responsibility for unauthorised access to user accounts.
§ 2 Use of the platform as a job seeker
2.1 Job seekers undertake to use the platform only for lawful purposes and not to publish any content that violates applicable law, public morals or these GTC.
2.2 Job seekers are solely responsible for the content they publish on Jobriver.de. Jobriver.de assumes no liability for the accuracy or completeness of this content.
2.3 Job seekers agree that employers who publish job listings can view their applications and profiles.
§ 3 Applications and data protection
3.1 Job seekers are themselves responsible for the content of their applications and should not publish sensitive personal information in their applications.
3.2 Job seekers agree that their applications and personal data may be processed by Jobriver.de and the employers in order to enable job placement.
C. Special Terms and Conditions for employers
§ 1 Registration as an employer
1.1 Employers must register to use job listings and other services on Jobriver.de. When registering, employers must provide accurate and up-to-date information.
1.2 Employers are responsible for keeping their user account and login details confidential. Jobriver.de assumes no responsibility for unauthorised access to user accounts.
§ 2 Publication of job listings
2.1 Employers are responsible for the accuracy and completeness of the job listings they publish.
2.2 Employers agree that their job listings and company information will be published on Jobriver.de.
§ 3 Use of employer branding products
3.1 Employers who use employer branding products are responsible for providing the supplied content in good time and in accordance with the agreed terms.
3.2 Employer branding products may have a limited term depending on the agreed conditions. Employers are responsible for ensuring that their content is available within this term.
